On December 30, President Lula issued Law No. 15082, establishing the National Biofuel Policy (RenovaBio). The current text amends Law No. 13576 of 26 December 2017, and now includes certified factories and raw material suppliers in the distribution of so-called carbon removal credits (CBIOs), in addition to improving the regulatory framework for the sector.
Minister of Mines and Energy, Alexandre Silveira, highlighted the importance of the new legislation for RenovaBio. “The RenovaBio program is an important slogan that President Lula has championed since the beginning of his administration. This initiative demonstrates its commitment to reducing greenhouse gas emissions very clearly. Now, we also appreciate the role of biomass producers in the program and tighten penalties on those who do not comply with their obligations.
The law also amends Legislation No. 9478 of August 6, 1997, which provides for proof of biodiesel withdrawal stock, and improves regulation of the sector through measures such as increasing fines for dealers who do not meet set targets.
Furthermore, failure to meet decarbonisation targets will now be classified as an environmental crime, and the sale of fuel to distributors who fail to meet their individual targets will be banned. The legislation also revokes the National Petroleum Agency’s license in cases of repeated non-compliance with targets.
RenovaBio is a program to decarbonise the transport matrix, with related impacts on the environment, contributing to the fulfillment of the country’s obligations under the Paris Agreement under the United Nations Framework Convention on Climate Change.
